This AI Risk, Limitation & Disclaimer Policy (the “AI Policy”) forms an integral part of the الابداع والامان لتصميم وتطوير أنظمة الحاسوب ذ.م.م d.b.a. AIVAC Legal Framework, including the Terms of Use, Privacy Policy, Subscription & Billing Terms, and Acceptable Use Policy.

By using any AI-powered feature of the Services, you expressly acknowledge and accept the risks described herein.

1. NATURE OF ARTIFICIAL INTELLIGENCE SYSTEMS

The Client acknowledges and agrees that:

1. Artificial intelligence systems are probabilistic, non-deterministic, and adaptive;

2. AI systems operate based on statistical models and training data;

3. AI outputs are not guaranteed to be accurate, complete, current, appropriate, or lawful;

4. AI behavior may vary between identical or similar inputs.

AIVAC does not control AI outputs in real time.

2. NO RELIANCE – CLIENT RESPONSIBILITY

The Services are provided as automation tools only.

You acknowledge and agree that:

- AI-generated outputs are not a substitute for human judgment;

- You must independently review and validate all outputs;

- You assume full responsibility for any action taken based on AI outputs.

You are solely responsible for:

- reviewing messages before deployment;

- monitoring live interactions;

- correcting or disabling faulty behavior.

3. NO PROFESSIONAL ADVICE

AIVAC AI systems do not provide:

- legal advice;

- medical advice;

- financial, tax, or investment advice;

- insurance, regulatory, or compliance advice.

Any use of AI outputs for regulated purposes is done entirely at your own risk.

4. AUTOMATION RISKS

You expressly acknowledge the risks associated with automation, including but not limited to:

- incorrect bookings or reservations;

- contacting unintended recipients;

- sending inaccurate or inappropriate messages;

- misunderstanding user intent;

- escalation failures;

- missed opt-outs or consent errors.

You accept full responsibility for these risks.

5. MODEL LIMITATIONS & BIAS

AIVAC makes no representations regarding neutrality, fairness, or bias elimination.

6. CLIENT CONFIGURATION & PROMPTS

AI outputs are influenced by:

- Client-provided scripts;

- prompts and configurations;

- business rules set by the Client.

You are solely responsible for:

- configuration accuracy;

- prompt legality;

- output appropriateness.

AIVAC bears no responsibility for Client-defined logic or instructions.

7. SERVICE AVAILABILITY & PERFORMANCE

AIVAC does not guarantee:

- uninterrupted operation;

- response times;

- call completion rates;

- message delivery;

- accuracy or success of AI actions.

Performance may be affected by:

- network conditions;

- telecom carriers;

- third-party platforms;

- system updates or maintenance.

8. THIRD-PARTY AI & DEPENDENCIES

AIVAC may rely on third-party technologies or models.

AIVAC:

- does not control third-party AI behavior;

- does not guarantee third-party availability;

- is not liable for third-party errors or outages.

9. CLIENT MONITORING OBLIGATIONS

You agree to:

- actively monitor AI behavior;

- promptly intervene if issues arise;

- suspend AI usage when required.

Failure to monitor constitutes Client negligence.

10. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL AI FEATURES ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

11. LIMITATION OF LIABILITY

All liability relating to AI features is subject to the limitation of liability set forth in the Terms of Use.

AIVAC SHALL NOT BE LIABLE for:

- incorrect AI outputs;

- automated decision consequences;

- business losses caused by AI actions;

- regulatory or contractual fallout.

12. INDEMNIFICATION

You agree to indemnify and hold harmless AIVAC from any claims arising from:

- reliance on AI outputs;

- automation-related errors;

- failure to supervise AI behavior;

- regulatory or third-party claims.

This obligation survives termination.

13. Amendments

We may update this AI Risk, Limitation & Disclaimer Policy from time to time. Updates will be posted on the Website with a new “Last Updated” date. Continued use of our Services after updates means you accept the revised Policy.

14. GOVERNING LAW & DISPUTE RESOLUTION

This AI Policy is governed by the laws of the Hashemite Kingdom of Jordan.

All disputes shall be resolved by binding arbitration in Jordan, conducted in English.
