ACCEPTABLE USE POLICY AND

TELECOM / MARKETING COMPLIANCE POLICY

This Acceptable Use Policy and Telecom / Marketing Compliance Policy (the “AUP”) governs all use of the الابداع والامان لتصميم وتطوير أنظمة الحاسوب ذ.م.م d.b.a. AIVAC Services and forms an integral part of the AIVAC Legal Framework.

Violation of this AUP constitutes a material breach of the Terms of Use and may result in immediate suspension or termination without refund.

1. PURPOSE OF THIS POLICY

AIVAC operates in a high-risk regulatory environment involving:

- telecommunications,

- automated calling,

- messaging,

- AI-generated communications,

- call and message recording.

This AUP exists to:

- protect AIVAC’s platform, licenses, and infrastructure;

- prevent regulatory, carrier, or platform enforcement;

- allocate full compliance responsibility to the Client.

2. GENERAL ACCEPTABLE USE REQUIREMENTS

You may use the Services only for lawful, ethical, and commercially legitimate purposes.

You agree that you will not, directly or indirectly, use the Services in any manner that:

- violates any applicable law or regulation;

- infringes the rights of any individual or entity;

- exposes AIVAC to regulatory, legal, or reputational risk;

- interferes with the integrity or security of the Services.

3. PROHIBITED USES

The following uses are strictly prohibited, without exception:

3.1 Illegal or Fraudulent Activity

- scams, phishing, or deceptive practices;

- impersonation or misrepresentation;

- fraudulent debt collection or threats;

- extortion or coercion.

3.2 Harassment & Abuse

- harassment, threats, or intimidation;

- discriminatory or hateful content;

- repeated unwanted communications.

3.3 Regulated or Restricted Activities

Unless explicitly authorized by law and disclosed to AIVAC in writing, you may not use the Services for:

- medical diagnosis or advice;

- legal advice;

- financial or investment advice;

- insurance underwriting;

- political campaigning or voter manipulation;

- emergency services or crisis response.

4. TELECOM & CALLING COMPLIANCE

4.1 Consent Requirements

You are solely responsible for ensuring that:

- all calls and messages are lawful;

- all required consents have been obtained;

- all disclosures (including recording disclosures) are made.

AIVAC does not monitor consent compliance.

4.2 Recording Compliance

Where call or message recording is enabled:

- you must notify all participants;

- you must obtain legally valid consent;

- you must comply with all applicable recording laws.

Failure to do so is entirely your liability.

4.3 Do-Not-Call & Opt-Out

You must:

- honor “do not call” lists;

- immediately process opt-out requests;

- maintain your own suppression lists.

AIVAC bears no responsibility for opt-out failures.

5. MARKETING & PROMOTIONAL MESSAGES

If you use the Services for marketing or promotional communications, you represent and warrant that:

- recipients have expressly consented where required;

- communications are truthful and non-misleading;

- required sender identification is included;

- opt-out instructions are clear and functional.

Any fines, penalties, or enforcement actions arising from marketing use are your sole responsibility.

6. PLATFORM-SPECIFIC COMPLIANCE (WHATSAPP / META / OTHERS)

If you use third-party platforms (e.g., WhatsApp, Meta, SMS gateways):

- you are responsible for complying with their terms;

- you bear the risk of suspension, throttling, or banning;

- AIVAC is not responsible for third-party enforcement actions.

Loss of access to third-party platforms does not entitle you to refunds.

7. AI-SPECIFIC MISUSE

You may not use the Services to:

- train competing AI models;

- generate deepfakes or impersonation content;

- bypass safeguards or system limitations;

- automate unlawful decision-making.

8. SECURITY & SYSTEM INTEGRITY

You must not:

- attempt unauthorized access;

- interfere with system performance;

- introduce malware or malicious code;

- scrape or harvest data from the platform.

9. MONITORING & ENFORCEMENT

AIVAC reserves the right to:

- monitor usage patterns;

- investigate suspected violations;

- suspend or terminate access immediately.

AIVAC has no obligation to provide advance notice.

10. CLIENT LIABILITY & INDEMNITY

You are solely liable for:

- all communications sent;

- all data processed;

- all regulatory compliance.

You agree to fully indemnify and hold harmless AIVAC from any claims, fines, penalties, or damages arising from your use of the Services.

11. Amendments

We may update this Acceptable Use Policy and Telecom / Marketing Compliance Policy from time to time. Updates will be posted on the Website with a new “Last Updated” date. Continued use of our Services after updates means you accept the revised Policy.

12. GOVERNING LAW & DISPUTE RESOLUTION

This AUP is governed by the laws of the Hashemite Kingdom of Jordan.

All disputes shall be resolved by binding arbitration in Jordan, conducted in English.
